Harper Doodles Contract

I. Buyer acknowledges that no claim/warranty of suitability for breeding, service, or competition is given. The Buyer agrees to spay / neuter their puppy by 12 months old, unless otherwise agreed upon between the Buyer and Breeder (as noted in the signed agreement). If proof of spay / neuter is not provided to the Breeder by 12 months old, this contract and warranty becomes null and void. This puppy is sold as a PET only, not for breeding purposes. If breeding occurs, either purposely or accidentally, a fee of $1,000 per live puppy is to be paid to the seller (Harper Doodles / Stephanie Harper).

II. This puppy comes with a 2-year health guarantee against debilitating congenital defects. Debilitating congenital defects are defined as those present since birth that are either life-threatening or would prevent the puppy from fulfilling the intended purpose for which it was purchased (i.e. as a companion). If the puppy is found to have a debilitating congenital defect within 2 years from birth, a replacement puppy of equal or lesser value will be given. Genetic testing of parent dogs decreases the odds that offspring are affected by the relevant diseases but said dog may be a “carrier.” Normal test results do not 100% guarantee a genetically clear puppy, but it is the best possible way for the Breeder to be proactive in producing healthy puppies. OFA testing of parent dogs confirms that we are breeding the most sound structures. 

III. Buyer has (3) business days from the time of receipt of said puppy (excluding Sunday and holidays) in which to have the puppy examined by a licensed veterinarian to determine “fitness for sale.” The Breeder retains the right to have said puppy examined by the Breeder’s personal veterinarian to confirm health of the said puppy. If the puppy is declared “unfit for sale,” the Breeder will exchange said puppy for one of equal quality of the same breed. If the requested gender/color is not available, buyer will be refunded the purchase price, less the nonrefundable holding fee. If the buyer foregoes the 3 day initial vet exam, the buyer forfeits the above conditions and will not be refunded, as the breeder can not verify that the reason for returning has resulted from negligence on the buyer’s behalf. Please ensure that the puppy is kept in a kennel or held in the waiting room of a veterinary office, and that the exam room is properly disinfected before the appointment. Do not let the puppy walk on the floor in the veterinary office and ensure the room was cleaned prior to putting your puppy on the table. I recommend bringing a clean towel or blanket with you to be safe.

IV. During the intial (3) day pickup period, if Buyer’s veterinarian diagnoses a debilitating congenital disorder not previously disclosed, the Breeder retains the right to have said puppy examined by The Breeder’s personal veterinarian to confirm defect, if within a reasonable distance. The Breeder retains the right to require a second opinion at a vet of the Breeder’s choice, at the Breeder’s expense if the Buyer is not local. A necropsy must be performed at the Buyer’s expense by a state-licensed DVM or veterinary teaching hospital if the puppy/dog dies, to determine cause of death. If the necropsy is undetermined or deemed inconclusive, the warranty is void.

If the defect is confirmed, the Buyer may choose a replacement puppy of equal or lesser value as one becomes available. No part or parcel of the veterinarian costs associated shall be refunded to the buyer, nor shall the holding fee be refunded.

Buyer must supply any requested vet records related to the dog’s condition within (2) business days of diagnosis.

 VI. Certification of infectious or contagious disease does not quality for exchange or refund. Breeder makes no guarantee against umbilical hernia, cherry eye, entropion, cancer, endocrine disorders, improper bite, or any delayed reaction resulting from vaccinations (i.e. kennel cough). Furthermore, Breeder makes no guarantee against worms, fleas, mites, coccidia, giardia, or allergies, as all of these may be environmental. The buyer is responsible for the costs associated with treating all above illnesses after the puppy leaves the Breeder. It is common for parasites to flourish after puppies join their new family - both stress and change fuel this. Most parasites are contagious and can spread to other animals in your home. If you are not willing to treat (it may take multiple treatments) your new puppy for these common problems, you probably should not purchase a puppy at this time.

 VII. Injury sustained after your puppy has left the Breeder is NOT covered under this limited warranty.

 VIII. Buyer assumes all rights, care, and responsibility financial and otherwise at time of sale.

 IX. Transfer: It is understood that if the Buyer is no longer able to care for this dog, the Breeder has the first right of refusal. If the Buyer is allowed to rehome the dog, no part or parcel of the protection provided by the Breeder to the original Buyer is transferrable.

X. Within the first (2) weeks, if the Buyer decides they can no longer keep the puppy for any reason (i.e. issues with a landlord, pet allergy, inability to tolerate a new puppy), it is the Breeder’s sole discretion to reimburse up to 50% of the purchase price stated in the agreement, less the reservation fee.

XI. Once the puppy reaches 8 weeks old and/or is cleared by the Breeder’s personal veterinarian for transfer of ownership, the Breeder allows a one-week grace period with no boarding charge. After the one-week grace period, a boarding fee of $100 per week OR $20/day will be incurred. This fee is non-negotiable.

XII. If the Buyer foregoes signing this contract or if the terms of this contract are not met, the warranty is NULL and VOID. The puppy will be sold AS IS with no guarantee or warranty.

 XIII. Any and all disputes will be handled in Baldwin County.

 

 I (WE), THE PURCHASER OF THIS PUPPY, HAVE READ ALL THE TERMS, CONDITIONS, AND WAIVERS OF THIS CONTRACT AND I (WE) AGREE BY OUR SIGNATURE TO ALL OF ITS TERMS.

what if the puppy i want is not available when it’s my turn to pick?

When it is your turn to pick your puppy, if the color / gender / temperament is not what you’re looking for, you may transfer your holding fee to another litter. We are always available to answer questions via text or phone call or by scheduling a Facetime. Customer service is a priority to us, as well as making sure you receive a well-adjusted puppy that suits the needs of your family.
